BIBHAV KUMAR SEEKS SUPREME COURT BAIL IN THE ASSAULT CASE OF DELHI WOMEN’S COMMISSION CHIEF SWATI MALIWAL

Background -

The case arises from an incident that took place in June 2024, when Swati Maliwal accused Bibhav Kumar of assaulting her physically during a public event in New Delhi. She maintained that during their heated exchange, Kumar went physical with her, causing her bodily harm and mental agony. Thereafter, following this complaint, a FIR was registered against him under sections related to assault and criminal intimidation under the Indian Penal Code (IPC). On his part, Kumar has refuted all these allegations as baseless and politically motivated. So far, lower courts have denied his bail applications on the grounds of the gravity of the charges and the need for a thorough investigation.


Update -

Challenging the decisions of the lower courts and seeking interim bail, Bibhav Kumar has now moved to the Supreme Court. This is because, defendant’s  counsel maintains that the lower court overlooked evidentiary contradictions in the complaint and there is no substantial proof against Mr. Kumar. The petition points out procedural mistakes in the investigation and claims his continued detention amounts to an infringement of his right to personal liberty. On 26th July, 2024, the Supreme Court allowed a hearing for a bail application by Kumar, suggesting that it could be an accelerated trial considering the nature of the allegations and their possible effects on his professional practice.

The decision by the Supreme Court to entertain Bibhav Kumar’s plea for bail marks a turning point in this sensational case.
