Hi, I am thinking to buy a flat on 3rd floor in Bangalore .The building is approved for G+3 but the builder has made 4th floor also which is illegal. So it has become G+4 now. Now, I want to know what will happen in case authorities are going to take action? Will they just demolish the 4th floor or entire building? I don’t want to go ahead for paper verification until and unless this doubt is cleared. Thank you

Dear Client, As per your query, If a building in Bangalore has been sanctioned for G+3 and an unauthorized fourth floor has emerged, the enforcing authority would demolish only the unauthorized fourth floor, or, in the more serious case, the entire building when such infraction causes impairment to its structural integrity or safety, under Section 321 of the Karnataka Municipal Corporation Act, 1976. Alternatively, schemes like Akrama-Sakrama may legalize the unauthorized construction but only after paying some penalty on certain conditions. On buying such a property ensure all the Completion and Occupancy Certificates are in order and that there is no violation or any litigation pending against the property so that after sometime, when government takes action, it will result in loss of your money. Dear Sir, They never demolish G+3 and the illegally constructed 4th floor is under danger. But 30% of buildings with G+3 Permissions having constructed 4th floor. If other documents are ok you may purchase the same. It is advised to go for bank loan at least for some amount so that they can verify the documents.
