We have a land in village with possession over 60 70 years minimum. But it is registered in someone else's name. Back in the day grandfather got the property in return of some favor but he never got it registered under his name. Now we have been using the same for at least 60 to 70 years and no objection and the whole village knows. Now those in whose name it is registered have now given their bhoo mafia complain for illegal possession in tehsil magistrate office. The inspection happened and it was in our favor that we have not illegally occupied the space. We were getting some construction done there then they came and threatened and also filed complaint against us..We live in Noida and the case is of bulandshahr.

Dear Sir, You may file a suit for permanent injunction or declaration on the basis of adverse possession.

Dear Client, As per your query, in your land dispute case, you can claim ownership through adverse possession under the Limitation Act, 1963, as your family has been in continuous possession for 60-70 years without objection. Since the inspection favored you, use that as evidence in responding to the Bhoomi Mafia complaint. You should consider filing a suit for declaration of title to legally transfer the property in your name and prevent future disputes. Additionally, you can seek an injunction to stop the other party from interfering with your possession or construction, and file a police complaint if you face threats. Feel free to book an appointment for a detailed discussion on the issue.
