NA plots 606 sold by developer. No society formed. Builder maintainence is in contract. Majority members if apply for a non cooperation society formation, would the registrar ask the developer for his views by sending a notice. What would the registrar do.

Dear Sir, First form your own society then start action against the builder. Then the Registrar will have strong powers.

Dear Client, As per your query, if the majority of the owners of the NA plot want to obtain a registration under Maharashtra Co-operative Societies Act, 1960, the registrar will probably issue a notice to the developer to seek their views especially if the developer has contractual obligations like maintenance. And then under Section 8 and Section 9 of the Act, the registrar will inspect the application and respond to the views of the developer. If the requirements of the enactments are fulfilled and the applicant developer does not have legal grounds upon which to object to such incorporation, the Registrar may register the society under Section 9 upon the issuance of a registration certificate.
