Few days ago, I made a payment through cheque, which was declined due to insufficient funds. I repaid the amount in cash. However, I got a legal notice for cheque bounce from the same person. What should I do now?
Please file a declaratory suit immediately. However if they file cheque bounce complaint, you will have to defend that also.
Dear Sir, You cannot do anything as you have not lodged the complaint for return of the cheque immediately. Any way you may issue strong reply notice and lodge police complaint at least now for misusing your cheque.
Dear Client, Taking above points into consideration, take legal assistance wherein you can get into contact with a legal professional and reply to that legal notice declining the claims if you had already made the payment and have sufficient evidence to prove the same From the above stated facts, it is a matter of dishonor of cheque u/s 138 of NI Act, which talks about Dishonor of cheque, However when you have repaid the amount to the complainant it is certainly expected that you have a receipt from that person concerned person / bank with his/her signature or any other kind of documents which shows that you have made the payment for the same. In furtherance when you have made the payment, it also expected that you had any witnesses present there who saw that you paid that amount. Thus if you have followed the above steps it will easy for you to prove before the court otherwise you must show any valid evidence which prove your innocence. hope this answers your query, Thank you.
If you have made the payment in cash then you should have the cash received and signature from the same person in that case you are safe enough or at least you should have 2 witnesses in front of whom you have given the cash to the same person otherwise you will have to prove it in court as to when and where you have given the amount in cash otherwise the cheque bounce case will stand against you and you will be liable to pay the entire amount of the cheque
