Hi, I'm Shoba Rani from Andhra Pradesh. I'm facing property issue. For my grandparents they are three kids. They are boys. My grandfather is a government employee in municipal corporation. We lost him in 2005. After his death, that job given to my dad and insurance some other money took by my two uncle's. For my dad, we are two girl child's. For my first uncle one girl and boy. Second uncle two boys and one girl child. My father died in 2017, my dad job came to my mom. In 2017, my last uncle also died in the month of sep. Last aunty is local tailor. My grandmother is also no more, she passed in 2020 dec 24.Now, they both are telling us to vacate house and go somewhere. Because, they are telling they given my grandfather job and we are girls so no need of share in the property. They are demanding leave job or leave home. Both we won't give. What they are doing is correct? This issue is occurring after my dad death before that they haven't spoke about property issue. After my papa death, they both started rumor like my papa told that I'll give for both 5lacs each, you guys can start business. This is false rumor because when my father is there they haven't told this thing and we don't know.Could you please suggest anything. We will need justice.
Dear Madam, There was no such oral or written agreement previously as such you can continue your stay in the house and file a suit for permanent injunction.
Dear Client, You and your sister both have the rights over your grandfather’s and father’s property under the Section 6 of the Hindu Succession Act, 1956 that makes both daughter and son equal. Your uncle cannot do this to you because from the amendment made in 2005 daughters are equal to sons in coparcenary property. Your father was supposed to leave you and your sister his job and any other valuables such as the insurance money not your uncles. The facts that were inside were rumors of your father with a promise of giving money to your uncles are irrelevant to the law. Thus it is recommended to consult a lawyer to make the appropriate claims and build a case, if necessary. As a proper strategy, you can fight for what belongs to you in the family property. I hope you find this answer beneficial in solving your problem.
