I got married in 2021 as per Hindu rituals, but we have not registered our marriage as of now. Is registration of marriage mandatory for Hindus? If yes, will it be difficult for us to get our marriage registered?
Dear Madam, Only few State made the marriage as mandatory. Registration is not so difficult.
The Marriage, if done correctly as per Religious Rites, that is final and binding, in personam between you both and in rem to the society. Registration is not part of Religious Rites. However, only for certain benefits, the Certificate issued by Government will be necessary. The Registrar will issue application form, in which the evidence to be produced is written. Produce them and get Registered. However, for your peace of mind, as per personal law, Religious Rites alone is sufficient.
Under the Hindu Marriage Act, 1955, there is no mandatory requirement for registration of marriages performed under Hindu rituals. However, Section 8 of the Hindu Marriage Act provides for the voluntary registration of marriages by the State Government. The Supreme Court of India, in its judgment in 2006 (Seema v. Ashwani Kumar), directed that all marriages, irrespective of the religion of the parties, should be compulsorily registered.
