My father works in an interior designing firm registered in Delhi,I don't know if he is a regular employee,but he gets proper "work order" document, relating to paint job of sites like bank offices, the "work order" mentions everything in detail like site area,cost of different type of paint job, travel allowance etc, he then takes some men along with him to the site address,and completes the paint job with his team I wanted to know,is my father eligible to be covered under ESIC scheme,since he doesn't get a regular salary ,but gets paid when he finishes the site ,submits the bill,and the bill gets approved.

In ESIC scheme you have to enrol yourself as a contactor. You also have to make certain government documents which will establish your firm’s name. The liability of a such a civil contactor increases as if there is any dispute between the person giving us the contract and our team then we have to handle it also if there is any accident such as any workers falls from the site of say 3rd floor or 10th floor and it results in death or other hazards then you have to pay a minimum compensation of Rs. 7 lakhs or you will have to get all your employees insured in Group insurance or you will have to stay in jail for 7-10 years so becoming a contractor is not too easy.
Dear Sir, It appears your father was only contract to do the jobs assigned by the other party. In my opinion his services may not be covered under EPFO and PF. Any way you personally contact any advocate who expert in labor court matters and show all the documents and such expert may help you.
