I want to know that if it is legal in India to record a video of a minor boy and girl together on a public road
Dear Client, In India, there is legal grey or unclarity about the recording a video of the minors in public areas. However, in view of the fact that individuals in public places do not enjoy full or high level of privacy. Legal and ethical concerns as well as the rights of children should not be compromised. People’s Right to Privacy as enshrined in the Constitution under Article 21 bars anyone from making recording without the Consent of the person being recorded and the Protection of Children from Sexual Offences (POCSO) Act, 2012 would prevent harm to Children. Thus, even if one is not breaking any law by recording minors in public spaces, it may be ethical and best not to do so if one is not willing to face legal troubles or be accused of malfeasance by the parents of the minors in question. Hope this answer solves your query.
In public place you can record any incidents of any persons subject to that their privacy is not at stake.....or the privacy is not hampered...
Dear Sir, You must be a close relative or well wisher of one the minor. Such recording should not be used for blackmailing them.
