When we talk about Will, it is a legal document which contains in written form the wishes of the person regarding who inherits his/her assets after death. Since a Will becomes enforceable only after death of the testator, i.e., the person whose asset distribution is planned through the same, assessing the genuineness of the same becomes unavoidable.
The law provides for Will Probate, the legal process through which the validity and genuineness of a Will is confirmed by the Court of jurisdiction. It also gives the legal authority to the executor of Will to carry out with the implementation of the Will as outlined in the document itself.
Since a Will can be obtained by fraud, Will probate is the legal process which aims at keeping up with the sanctity of the document and the wishes of the deceased with regards to his/her assets.
